Terms and Conditions Blechbläsersortiment Köbl

1. Scope

Pertaining to the business relationship between the company Blechbläsersortiment Köbl and the purchaser, the following general terms and conditions, in the form they appear at the time of product order, apply exclusively. Alternative customer conditions require the express written permission of Blechbläsersortiment Köbl.

2. Conclusion of contract

The order represents a purchaser offer made to the company Blechbläsersortiment Köbl, concluding with a contract of sale. The purchase agreement is completed only after delivery of goods, order confirmation or notice of shipment. Should the customer receive neither an order confirmation, nor notice of shipment or goods within two days of order, he/she is no longer bound to this order. Any payments already made will, in this case, be refunded immediately.

All products are sold only in limited quantities. This refers both to the number of products ordered within one order, as well as to multiple orders of the same products. A sale is made only to persons who have reached the age of 18.

3. Details regarding payment, payment date, delivery and order completion

Unless otherwise noted, delivery will be made to the address provided by the customer for this purpose.If delivery to the buyer is not possible, because obstacles exist at customer's address for delivery, eg., the goods cannot be brought through the entrance, house or apartment front door, up the staircase or into the elevator, or because the customer is not available at the his/her provided delivery address, although the delivery time has been communicated with reasonable notice, the purchaser shall assume the cost of the failed delivery.
The purchase price is payable upon delivery of ordered goods. Purchaser may pay the purchase price via credit card or PayPal, or by paying in advance. In Germany, Austria, Switzerland, Holland and in Luxemburg, payment by invoice is also possible. If the purchaser defaults on payment,Blechbla¨sersortiment Köbl is entitled to charge default interest at the rate of 5 percentage points above the base rate per year announced by the European Central Bank. Should Blechbläsersortiment Köbl be able to prove greater loss incurred due to the delay, Blechbläsersortiment Köbl is entitled to claim this loss

4. Prices

All prices quoted on the Blechbläsersortiment Köbl website are in euros and include VAT plus shipping costs.

5. Retention of ownership

Blechbläsersortiment Köbl retains ownership of delivered goods until full payment is received.

6. Cancellation policy

a) Cancellation

You have the right to cancel this contract within fourteen days without stating a reason.
Cancellation period is fourteen days from the date you or a third party known to you, but who is not the carrier, took possession of the goods.
To exercise your right of cancellation, you must inform us (Blechbläsersortiment Köbl, Sommerstraße 9,81543 München,+49 (0)89 / 863 35 53, E-Mail: info@koebl.de ) of your decision to withdraw from this contract. You can use the cancellation form for this purpose, or you can inform us via telephone. In order for the cancellation to be valid, it is sufficient for you to send your cancellation message prior to the cancellation deadline.

b) Consequences of cancellation

If you cancel this contract, we must return all payments received from you immediately and at least within fourteen days after notice of cancellation was received via your contract cancellation. This includes delivery costs (with the exception of additional costs incurred if you chose a method of shipment other than our economical standard shipping). Repayment will follow the same payment method you used for the initial transaction, unless we have explicitly agreed otherwise; in any case you will not be charged for this repayment. We may withhold reimbursement until we have received the returned goods, or until you have given us proof of returned goods, whichever date is earlier. You must return the goods promptly, and in any event, no later than fourteen days after you informed us about the cancellation of this contract. The deadline is met if you return the goods within the fourteen day cancellation period.
You assume the direct cost for returning the goods.
You need to pay for any deterioration of the goods, only if it can be proven that deterioration of the nature, characteristics and functioning of goods resulted from your unnecessary handling of the product.

7. Exclusions from cancellation

The right to cancellation does not apply to distance contracts

• - pertaining to the supply of goods which are not prefabricated and which are chosen and modified for the consumer or which require individual tailoring to meet consumer specifications,
• - pertaining to the delivery of goods, if, due to their nature, they were inseparably mixed with other goods after delivery,
• - pertaining to the delivery of newspapers, periodicals and magazines.

8. Return shipment costs

In exercising your right of cancellation, you must pay the regular return shipment costs, if the delivered goods correspond to those ordered
When not shipping via parcel (freight) fare, only you must assume the costs for return shipping if we have previously specifically determined the amount of the return costs in the cancellation policy, or if the costs cannot be reasonably calculated in advance, have estimated and specifically communicated the maximum amount of the return shipping costs.

9. Warranty

Statutory warranty rights apply. If a replacement delivery is made, the purchaser is, at the request of Blechbläsersortiment Köbl, required to return the initially delivered defective goods to Blechbläsersortiment Köbl within 30 days

10. Place of performance and jurisdiction

German law applies. If the purchaser resides outside of Germany, it is agreed that the Blechbläsersortiment Köbl headquarters shall have exclusive jurisdiction.
